Effective Date: January 1st, 2026
These Terms apply to all photography services provided by Kamen Snap Shot (“Photographer,” “we,” “us”) to the client (“Client,” “you”). By booking a session, paying a deposit, signing any booking form, or participating in a session, you acknowledge you have read, understood, and agree to these terms.

• Kamen Snap Shot provides on-location family and portrait photography by appointment.
   
• Availability is primarily weekday evenings and weekends.
   
• Sessions are typically scheduled within 25 miles of The Shoppes at Dos Lagos. Locations outside this range may be approved at our discretion and may require additional travel fees.
   

• Session pricing is advertised on our website and may be updated at any time; your booked rate is locked in once your deposit is received.
   
• A non-refundable deposit is required to reserve the date/time. The deposit is applied toward your total balance.
   
• The remaining balance is due no later than the day of the session (or earlier if stated in your booking confirmation).
   
• Additional fees may apply for: (a) selected locations, (b) permits/entry/parking, (c) extended family groups, (d) travel beyond 25 miles, (e) add-ons, or (f) rush delivery.
   

• Some locations require additional time/coordination or have access restrictions. A location fee may be assessed based on your selected location.
   
• Permits, entry tickets, and parking fees are the client’s responsibility unless we expressly agree otherwise in writing.
   
• If a location denies photography access, security removes us, or permits are not obtained in time, we may move to an alternative nearby location or reschedule at our discretion.
   

• Deposits are non-refundable because the reserved time is removed from availability.
   
• One reschedule may be granted with 48+ hours notice, subject to availability.
   
• Late cancellations/reschedules (under 48 hours) may require a new deposit to rebook.
   
• If the photographer cancels due to emergency or unforeseen circumstances, the client may reschedule or receive a refund of payments made (including the deposit).
   

Outdoor sessions depend on conditions. If weather, smoke/fire conditions, unsafe conditions, road closures, government restrictions, or other events beyond our control (“Force Majeure”) prevent quality or safe shooting, we may reschedule or relocate. We are not liable for delays or nonperformance caused by Force Majeure.

To keep sessions safe and productive, the Client agrees:

• To arrive on time and prepared. Late arrival reduces shooting time.
   
• To supervise minors at all times. The photographer is not responsible for childcare or supervision.
   
• To disclose any special needs, mobility concerns, or important shot requests before the session.
   
• To manage personal items and valuables; we are not responsible for lost or stolen items.
   

On-location photography may involve uneven terrain, wildlife, insects, weather changes, crowds, traffic, water features, and other hazards. The client and all participants voluntarily assume all risks associated with the session location and travel to/from the session.

To the maximum extent permitted by law:

• Client releases and holds harmless Kamen Snap Shot from claims for injury, loss, or damage arising from participation in the session, including at public or private locations, except where caused by our gross negligence or willful misconduct.
   
• Our total liability for any claim (contract, tort, or otherwise) is limited to the amount actually paid to us for the session in question.
   
• We are not liable for indirect, incidental, special, or consequential damages (including loss of enjoyment or missed moments).
   

• We deliver images consistent with our portfolio style (color, contrast, exposure, composition, and artistic judgment).
   
• Edited image counts are based on the package selected. The client selects favorites from a proof gallery unless otherwise stated.
   
• Turnaround times may vary by season; typical delivery timelines will be provided at booking.
   
• We do not provide unedited RAW files.
   

• The photographer retains full copyright to all images.
   
• The client receives a personal-use license to download, share, and print images for personal use.
   
• Client may not sell images, enter commercial contests, or use images for advertising/branding without written permission from Photographer.
   

Client grants Photographer permission to use session images for our portfolio, website, social media, advertising, samples, and promotional use.

Opt-Out: If you prefer your images not be used publicly, you must notify us in writing before the session. We will honor the request. (Optional: You may add a privacy fee if desired: “A $___ privacy fee applies to opt-out requests.”

The client is responsible for respecting rules and property at the chosen location. Client agrees not to request unlawful conduct or trespass. If any participant behaves in a threatening, unsafe, abusive, or inappropriate manner, the photographer may end the session immediately with no refund.

Client agrees to indemnify and hold harmless Photographer from claims, damages, and expenses (including reasonable attorney fees) arising from Client’s breach of these Terms, Client’s negligence, or misconduct of session participants.

These Terms are governed by the laws of the State of California. Any dispute will be brought in the state or federal courts located in Riverside County, California, unless otherwise required by law.

By booking a session, paying a deposit, signing a booking form, or participating in a session, the client acknowledges and agrees to these terms and confirms they have the authority to agree on behalf of all participants (including minors, where applicable).
